Tacoty Studio Privacy Policy

Tacoty Studio (“Tacoty”, “we”, “our side”) is committed to protecting your privacy. This privacy policy applies to the Tacoty application (“application”), the Tacoty website, and all other services provided by Tacoty (collectively referred to as “services”). When collecting, using, and processing “personally identifiable information” (as defined below), we follow the following principles:

Users in different regions may be subject to different data protection standards. This privacy policy has a section specifically for EU residents and their privacy rights.

“Personally identifiable information” is information about an identifiable individual. In some jurisdictions, it is called “personal information”. In the section of this privacy policy specifically for EU residents (Appendix A), the term “personal data” is used.

We collect

The information we collect We may collect your personally identifiable information, including but not limited to contact information and information about your use of the services, including your responses and information about the device or platform you use to access the application (collectively referred to as “your information”).

Information we obtain from your use of the services.

When you use the services, including installing the application, contacting us (for example, by using our contact form, subscribing to a mailing list or our tester group, through a user survey on our website, and/or being prompted in other ways in our services), or otherwise requesting communication or using the application, we may collect the following categories and specific information about you: your contact information (i.e., your email address, your name), your IP address, your questions, suggestions, concerns, or other types of feedback about the services, your country of residence, the duration of using the application, your self-reported skill level, and the type of work or occupation you are engaged in.

Information we obtain from cookies and other similar technologies.

In order to improve and enhance your experience and the overall quality of the services, we (or a third-party provider on our behalf) may use “cookies”, “web beacons”, or other similar technologies (collectively referred to as “cookies”). This part only covers our use of cookies and does not cover any third-party use of cookies.

Do Not Track signals.

Currently, when we see a Do Not Track (DNT) signal from a browser, the website does not change its data collection and use practices.

Mobile device access.

We may request information about certain features of your mobile device, access these features, or obtain permissions for these features, including the camera, microphone, sensors, and other features of your mobile device.

Push notifications.

We may request to send push notifications about certain features of your account or the services to you.

How we use your information

We may track, measure, and/or analyze the information we collect about you.

For providing services.

Your information may be used or disclosed to facilitate the provision of the application or other services, such as saving ongoing sketches, used functions, and your application preferences, and to respond to questions or concerns. We may send updates about product releases, tips, and editorial content in the digital art world.

For improving services and other business purposes.

We may use your information to improve and optimize our application and other services, through data analysis, determining usage trends, determining the effectiveness of our promotional activities, and evaluating and improving our services, products, marketing, and your experience, such as calculating the number of ad impressions, verifying the targeting and quality of ad impressions, and auditing compliance with this specification and other standards. We use and store this information in a de-personalized, aggregated, and thus anonymous form so that it is not related to a single end-user and does not include information. We will not use information without sufficient legal basis, including but not limited to your consent or any other legitimate interest. We may, at our discretion, allow our tester group to access the pre-release version of our application for testing and feedback.

For monitoring and protecting services.

We may use your information to help us screen potential risks and fraud (especially your IP address), monitor traffic patterns, service usage, and related information, such as debugging to identify and fix errors that damage existing expected functions; conduct activities to verify or maintain the quality or security of the services; detect security events, prevent malicious, deceptive, fraud, or illegal activities, and prosecute those responsible for such activities.

For marketing and promotion.

We and/or our third-party marketing partners may use the information we collect according to our marketing purposes if it conforms to your marketing preferences. For example, when you indicate an interest in learning about us or our services, subscribing to receive marketing communications, or otherwise contacting us, we will collect information from you. You can choose to opt out of our marketing communications at any time.

Other business purposes.

We may use your information for other operational purposes compatible with the context in which the information was collected.

Sharing your information

In the course of our business, we may share your information with trusted third parties, service providers, or partners. Any disclosure of your information will comply with the terms of this privacy policy.

Disclosure for providing services.

We may disclose your information to trusted third parties, service providers, or partners who perform services or functions on our behalf for business purposes. For example, our service providers include companies that assist us with marketing, consulting, communication, software maintenance and support, analysis, social media, market research, effective use verification, license compliance, security, user verification, and localization.

Disclosure for business development, promotion, and marketing.

As part of the services, your information may be disclosed in an aggregated or anonymous form to third parties (including potential partners and sponsors) to provide statistical data and other analyses about the use of the application or our other services. We may also use services provided by third parties to provide you with targeted content and interest-based advertisements and communications, and optimize our marketing efforts.

Disclosure according to law.

If required by law, requested by a third party, or if we believe the disclosure is reasonable, to (1) comply with the law, a law enforcement request or order, or any legal procedure; (2) protect or defend the rights or property of Tacoty or a third party; or (3) protect someone's health or safety, for example, when someone (including you) is injured or threatened with violence, we may disclose your information.

Disclosure by Tacoty to a trusted third party.

If we believe that business needs reasonably require it, we may provide your information to our affiliated companies or other trusted enterprises or individuals. For example, we may disclose your information for external processing or to utilize the services of a technical assistant or a customer service provider. However, all third parties with access to your information will comply with the terms of this privacy policy as well as other appropriate confidentiality and security measures.

Disclosure to third-party products or advertisers.

The services (including the application) may enable you to interact with third-party websites, mobile software applications, advertisements sent directly from third-party advertisers to you, and services that we do not own or control (each called “third-party services”). We are not responsible for the practices or content of these third-party services. Please note that third-party services may collect personally identifiable information from you, use your IP address for rewards or promotions, and may download cookies to your device (computer or mobile phone). They may also use other technologies to personalize and measure the effectiveness of their advertisements, promotions, or other services. The cookies of third-party advertisers are not covered by this privacy policy, and we cannot control the practices of third parties. Therefore, we encourage you to read the terms and conditions and privacy policies of each third-party service you choose to interact with or use.

Protection and retention of information

You can request the identification, modification, or deletion of your information by sending an email to the following contact information. We may require certain information for verifying the identity of the individual seeking access to their information record and may limit access to the information as needed. We may need up to 30 days to confirm and complete the user deletion.

Children's Privacy

If you are under sixteen years old, before using our services, you must first review the terms of this privacy policy with your parents or guardians to ensure that you and your parents or guardians understand the terms and conditions and agree to them. If you have reason to believe that a child under 16 years old has provided information to Tacoty through the services, please contact us and we will try our best to delete the information from our database.

Changes to the Privacy Policy

The services and our business may change from time to time. Therefore, we may change this privacy policy at any time. When we do so, we will post an updated version on this page and change the “last updated date” above, unless applicable law requires other types of notice. You should regularly consult this privacy policy to understand any changes. After we post an updated privacy policy, by continuing to use the services or providing information to us, or, if applicable, after being notified, you agree to the revised privacy policy and the practices described therein.

International Users

Tacoty is headquartered in China. If you access our services from the EU or other regions with data collection and use laws, please note that your information, including but not limited to the personal data defined in Appendix A, will be transmitted to our servers in China when necessary to provide you with the services you request, manage our contract with you, or respond to your requests as described in this privacy policy, and the data may be transmitted to service providers that support our business operations (as described above). The data protection laws in China may not be as strict as, or may be different from, the laws in your country/region. For more information about the rights of EU residents, please see Appendix A.

California Privacy Rights

The 2018 California Consumer Privacy Act allows California consumer residents to submit requests, such as for certain information about our collection of information or disclosure to third parties. They can in particular request:

A business that provides any financial incentives should notify the consumer of the financial incentives, and only if the consumer has chosen to consent in advance and clearly describes the important terms of the financial incentive plan and the consumer can revoke the consent at any time, can the business include the consumer in the financial incentive plan.

Please note that we currently do not maintain such a financial incentive plan but we reserve the right to change this plan on our own. Please note that we currently do not sell any of such consumer's personal information. Appendix A. Scope of EU (European Union) Users.

This section applies to you if you are a user in the European Union (for the purposes of this section, references to the EU also include the EEA (European Economic Area) countries of Iceland, Liechtenstein, and Norway, as well as Switzerland and the United Kingdom where applicable, provided that the latter is considered a third country from the perspective of the EU and vice versa).

Tacoty Studio is the data controller for the processing of personal data (as defined below) provided to us through the Service.

Please note that we do not currently maintain any automated decision-making, including profiling, but we reserve the right to change this at our discretion.

Subject to the applicable EU law, you have the following rights over your personal data that we hold:

Legitimate Interests.

"Legitimate interests" refers to the interests we have in conducting and managing our business and providing services to you. This privacy policy describes when we process your personal data for our legitimate interests, what those interests are, and your rights. We will not use your personal data for activities that have an impact on you that outweighs our interests.
